"More than 30 Hezbollah operatives, including 10 members of the terror group’s elite Radwan Force, were killed in one area of southern Lebanon during ground operations in recent days, the military says.

The military says troops operating with the 91st “Galilee” Regional Division killed the 30 operatives with tank shelling, sniper fire, drone strikes, and by directing airstrikes in their area of operations."

"The IDF announces that it killed the top leadership of the Islamic Revolutionary Guard Corps (IRGC) Navy, including its commander, Alireza Tangsiri.

The overnight Israeli Air Force strike in the Iranian port city of Bandar Abbas was carried out while Tangsiri was meeting with senior officers of the IRGC Navy.

In addition to Tangsiri, the IDF says the strike also killed the IRGC Navy’s intelligence chief, Behnam Rezaei. The military does not immediately name other top commanders killed in the strike..."

"No injuries are reported following Iran’s latest ballistic missile attack, the seventh salvo since this morning.

A small number of missiles were launched in the attack, which triggered sirens across central Israel and on the outskirts of Jerusalem. The IDF says some of the missiles were successfully intercepted by air defenses.

Rescue forces are responding to reports of an impact in central Israel, possibly caused by falling fragments."

"Pakistan’s Foreign Minister Ishaq Dar confirms that indirect negotiations between the United States and Iran are being held to end their war, using Islamabad as an intermediary.

Dar, who is also deputy prime minister, describes speculation about “peace talks” as “unnecessary,” adding: “In reality, US-Iran indirect talks are taking place through messages being relayed by Pakistan.”

“In this context, the United States has shared 15 points, being deliberated upon by Iran. Brotherly countries of Turkiye and Egypt, among others, are also extending their support to this initiative,” he writes on X, using Turkey’s official name...."

"Hezbollah has fired over 600 times on Israel and IDF troops in the last 24 hours, around double its prior high of around 300 aerial threats during the 2023-2024 conflict between the sides, IDF sources have confirmed.

The vast majority of the rockets, mortars, and drones were launched at IDF forces holding positions in or seeking to advance within southern Lebanon.

This major spike in Hezbollah attacks, up from a general average of around 100 attacks per day during the current war, occurred in the shadow of a possible end to the Israel-Iran war. Despite increased expectations of such a potential ceasefire, Israel has made noises that it may wish to continue pummeling Hezbollah with airstrikes as well as to continue its invasion of southern Lebanon.

Hezbollah's spike in attacks on Israel and IDF forces is likely not sustainable, but could be part of an effort to coerce Israel and the US into a ceasefire on all fronts, or to convince Israel to withdraw from southern Lebanon..."

"As US President Donald Trump issued a threat to the Iranian leadership to "start getting serious about the diplomatic option", the United States has been mobilizing a number of elite units to the Middle East, signaling that if diplomacy fails, a "conquest" strategy would be ready for activation.

At the center of Trump's buildup is the 82nd Airborne Division and two amphibious ready groups, a move that experts suggest is aimed directly at Iranian strategic interests, such as Kharg Island in the Persian Gulf.

The 82nd Airborne Division, often referred to as the "911" of the US Army, is recognized for its ability to be anywhere on the globe within 18 hours, and it's currently positioning its command staff in the Middle East. Their mission is to provide a rapid-entry force capable of seizing airfields and holding territory until heavy reinforcements arrive...."

"Iran's Islamic Revolutionary Guard Corps has lowered the minimum age for participation in war-support roles to 12, a senior official acknowledged on state television, in remarks cited by the Iranian news channel Iran International.

Rahim Nadali, a cultural official in the IRGC's Tehran branch, said an initiative called "For Iran" has been recruiting participants to assist in activities such as patrols, checkpoints, and logistics. According to his remarks, most of the minors being recruited are being directed to the Basij, which is responsible for suppressing opposition to the regime.

"Given that the age of those coming forward has dropped and they are requesting to participate, we lowered the minimum age to 12," he said, adding that children aged 12 and 13 can now join if they wish. The remarks were broadcast as part of state media coverage of the war effort. The move comes despite Iran's commitments under the Convention on the Rights of the Child, which prohibits the use of children in military activities. The steps also point to growing desperation within the regime, following weeks in which US and Israeli air forces have been targeting Basij personnel, who have suffered heavy casualties. Morale among Basij fighters has also plummeted, driven by fear of strikes on checkpoints and headquarters, with many forced to sleep in streets and mosques. Videos circulating on Iranian social media show Basij members fleeing in panic after civilians play drone sounds through their mobile phones."

"An IDF soldier was killed overnight Wednesday–Thursday in a firefight with terrorists in southern Lebanon, during a ground operation by the 36th Division to expand the security zone. "The military campaign against Iran is not going according to plan. The longer it continues, the clearer that becomes. Rather than bringing down the regime, the campaign is, in several key respects, actually reinforcing it. Iran is successfully maintaining control over the maritime arena and the Strait of Hormuz, demonstrating resilience in the face of pressure from Israel and the United States, preserving a stockpile of approximately 440 kilograms (970 pounds) of uranium enriched to 60% purity, continuing to strike energy infrastructure, and sustaining a steady rate of missile and drone fire – all while preventing any significant signs of internal unrest, from mass protests to military defections.

In other words, a string of operational successes by the attacking side risks producing a worse strategic outcome. This is a dangerous paradox. Continuing the campaign in its current form does not bring its objectives closer – it pushes them further away. A war of attrition is precisely the strategic environment that serves Iran's interests.

On the other side of the equation, a significant escalation – whether a broad strike on infrastructure or a ground operation – would almost certainly trigger a sharp Iranian response, dealing a severe blow to the global energy economy and to the Gulf states. This points to the need for a diplomatic off-ramp. Not one that tries to maximize gains – because Iran, operating from a sense of achievement, will not accept that – but one that focuses on the single issue that truly matters: the nuclear file.

One reality must be acknowledged. As long as the Iranian regime exists, it cannot be prevented from building conventional military power. That process can be delayed, perhaps even significantly – but not stopped. The knowledge, the capabilities, and the determination are there. The real question, therefore, is not how to prevent Iran from growing stronger – but how to prevent it from becoming an existential threat. The answer runs through the nuclear issue.

If the enriched uranium stockpile – in particular those 449 kilograms (990 pounds) enriched to 60% – cannot be removed by force, then the goal must be an agreement focused on precisely that issue, even at the cost of accepting the regime's continued existence and even its further consolidation. The second alternative is to go all the way – a campaign aimed at toppling the regime, at enormous cost in security, economic, and diplomatic terms, and with no guarantee of success even then.

There is no third option, and you cannot hold a stick at both ends. Either a nuclear-focused agreement or a full-scale campaign with all that entails."

"For nearly a month, Saudi Arabia has absorbed waves of Iranian drone strikes and missile salvos targeting its cities and energy installations, with the kingdom refraining from hitting back — for now.

But fresh threats from Iran over possible plans to target the Red Sea, Saudi Arabia’s last remaining maritime route for shipping crude, may force the kingdom to consider taking an active role in the conflict.

Late Wednesday, as thousands of US troops were en route to the Gulf, an Iranian official said a new front on the Red Sea would be opened if Washington launched a ground invasion of its territory. For nearly a month, Saudi Arabia has absorbed waves of Iranian drone strikes and missile salvos targeting its cities and energy installations, with the kingdom refraining from hitting back — for now.

“The Bab al-Mandeb Strait is among the most strategic straits in the world, and Iran has both the will and the capability to pose a fully credible threat against it,” the official was quoted as saying by the Tasnim agency.

Following the outbreak of the war, Saudi Arabia began pumping millions of barrels of crude a day through a massive pipeline connecting its energy installations along its Gulf coast to export terminals on the Red Sea. The Petroline, as it is known, has helped cushion the war’s blow — allowing Saudi to bypass the now-closed Strait of Hormuz, where roughly 20 percent of global crude and liquefied natural gas supplies passed before the war.

A new front on the Red Sea, the gateway to the Suez Canal, would likely see the Iran-backed Houthi rebels in Yemen enter the fight.

Following the Hamas attacks on Israel and the start of war in Gaza in 2023, the Houthis managed to all but halt maritime traffic in the Red Sea by firing occasional missiles and drones at vessels in the waterway. The tactic would later be implemented by their allies in Tehran to economically devastating effect in the Strait of Hormuz.

But reprising the Red Sea attacks would likely trigger an immediate counterstrike by Riyadh.

“I believe that Saudi Arabia still maintains cautious neutrality in the Iran-Israel-US war,” Hesham Alghannam, a Saudi defense expert, told AFP.

“If the Houthis strike Saudi assets, Riyadh may shift toward defensive coalition support or limited retaliation.” The conflict spreading across the Middle East has undercut years of diplomatic moves by Riyadh aimed at maintaining stability in the Gulf and achieving a detente with Iran.

Following years of enmity, Saudi Arabia and Iran announced a surprise re-establishment of ties in 2023 in a Chinese-brokered agreement that saw embassies reopened, regular visits resume and a war of words recede. The U-turn came at breathtaking speed.

Only years earlier, Saudi Crown Prince Mohammed bin Salman had famously compared Iran’s late supreme leader Ali Khamenei to “Hitler” and launched a devastating proxy war against the Houthis that triggered international outrage from rights groups.

After agreeing to a truce in Yemen in 2022, Saudi Arabia threw its weight behind policies promoting regional stability, as its leaders doubled down on diversifying its economy and courting international investors and tourists — a strategy now jeopardized by the war.

The US-Israel attack against Iran on February 28 saw Tehran unleash a mutli-layered blitz hitting cities and energy facilities across the Gulf and choking off traffic in the Strait of Hormuz.

Ports, oil fields, natural gas processing plants and storage tanks were all targeted, including Saudi Aramco’s massive Ras Tanura refinery along the Gulf coast. With its vast size, Saudi Arabia has been able to absorb the strikes with greater ease than its smaller neighbors confined to the Gulf coast.

Multiple media reports have suggested that the Saudi crown prince has privately encouraged the Americans to continue the war and bring Iran to heel — a notion dismissed in Riyadh.

“The Kingdom of Saudi Arabia has always supported a peaceful resolution to this conflict, even before it began,” said a senior Saudi official in a statement to AFP. “We remain in close contact with the Trump administration, and our commitment remains unchanged.”

But as the war drags on, its patience is increasingly running thin, with the daily attacks against Saudi territory shattering what little trust existed between the former enemies.

“We have reserved the right to take military actions if deemed necessary,” Saudi Foreign Minister Prince Faisal bin Farhan told reporters hours after Iran fired ballistic missiles at Riyadh last week.

“And if the time comes, the leadership of the kingdom will take the necessary decision.”

A. Art of the Week

Persepolis: the ancient city of the Achaemenid Empire founded centuries ago by Darius the Great in succession from Cyrus. The Gate of All Nations invites visitors to this 3,000 year old ceremonial city celebrating the power of Persian culture and its echoing effect across the Iranian nation today. The Gate itself integrated the languages of the time — Elamite, Babylonian and Old Persian, with its symbols of strength but solemnity, showcasing power without threat, as the columns facing the public stand the Lamas, mythical legends with the bodies of a bull, the wings of an eagle, and the heads of the human leaders. Such legends still shape much of the Persian mindset to this day.

III. CLOSING ARGUMENT: Article I, Legislative Immunity

  • The Constitution affords Congress broad leniency in terms of transparency, internal operations, and immunity from the other branches of government in the exercise of its legislative duties.
  • First, under Article 1, Section 5, Congress can exempt any of its proceedings from public transparency whenever it “may in their Judgment require secrecy” from the duty to keep and publish the journal of its proceedings.
  • Second, under Article 1, Section 5, Congress “may determine the Rules of its Proceedings”, “punish members for disorderly Behavior”, and may expel a member “with the Concurrence of two-thirds.”
  • Third, under Article 1, Section 6, the compensation of members of Congress can be set by them, and must be paid out of the Treasury, prohibiting the power of payment from the executive branch’s control of the Congress. The Twenty-Seventh Amendment, the last amendment to be passed, limits this power to “until an election” has “intervened” between the time of the passage of a compensation law and its enforcement.
  • Fourth, under Article 1, Section 6, members of Congress are “privileged from arrest during their attendance” and during their transit, except for the limited crimes of Treason and Felony breach of the Peace.
  • Fifth, under Article 1, Section 6, no member of Congress can be questioned “in any other place” for any of their “speech or debate in either house”, the so-called Speech & Debate clause immunity from libel and slander suits for their speech inside the Chamber.
  • These privileges intend to afford members of Congress sufficient, but no more than sufficient, immunity from the other branches of government in order to capably, confidently, and competently perform their legislative duties. Of course, it can’t fix the corruptibility, cowardice, or constricted cognitive capacity of Congress.

A place to be still with nature and within it while outside its colder embrace.

III. CLOSING ARGUMENT: Article I, Defining War Crimes

  • Two sources in the Constitution provide the power to Congress to define war crimes.
  • First, Section 8 of Article I provides three separate sources of legislative authority, as Congress is a body of only defined, express powers, not inferred, implicit or broad powers. Article 1, Section 8 provides that Congress “shall have Power” to “define and punish Piracies and Felonies on the high Seas, and Offences against the Law of Nations”; “to declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water”; “to make Rules for the government and Regulation of the land and Naval forces.”
  • Second, the Congress enjoys the power to enforce Treaties. Article VI provides “all Treaties made, and which shall be made, under the Authority of the United States, shall be the supreme Law of the Land.”
  • The phrase “the Law of Nations” derives from a popular scholastic legal work in many a library of the Founding generation entitled: The Law of Nations, or Principles of the Law of Nature, Applied to the Conduct and Affairs of Nations and Sovereigns” by Emmerich de Vattel, published in 1758. Today, we know it by another name: international customs and law.
  • First, Vattel’s Law of Nations recognized war as illegal, and any actions taken in its kinetic course and conduct, as a crime against the law of nations whenever it is fought for reasons other than self-defense and securing essential rights of sovereignty, and even then, only after meaningful sincere diplomatic and peaceful efforts fail. This was colloquially called Just War, influenced by the Catholic intellectual tradition especially.
  • Second, Vattel’s Law of Nations required moderation, sparing civilians, treating prisoners with humanity, and especially prohibited denying quarter to those who have not violated the laws of war.
  • The early Congresses recognized their obligations to declare war by authorizing conflict with France, the Barbary pirates, and American tribes on the frontier. Presidents Washington, Adams and Jefferson all recognized their requirement for Congressional authorization to initiate force against foreign adversaries.
  • The very first Congress also accepted this Constitutional authorization and included the law of nations violations in its first Judiciary Act of 1789. The very first criminal prosecution ever in federal courts enforced these Law of Nations against Gideon Henfield for violating America’s neutrality in the British-French wars at the time. Chief Justice Jay identified the source of law for the prosecution: the Law of Nations, which Congress gave the courts the power to enforce under the Judiciary Act of 1789.
  • Treaties signed by the President and affirmed by the requisite vote in the Senate governing conduct in kinetic conflicts include: the Geneva Convention; The Hague Conventions; and the Pact of Paris of 1928. Congress codified several of the precepts and principles from these treaties and conventions into federal statutory criminal law, such as section 2441 of Title 18 of the United States Code, which include the death penalty as a possible sentence.
  • The key criminal prohibitions for grave violations of these treaties and the Law of Nations, include: torture; curly or inhumanity toward anyone in custody or control; biological experiments; and murder, mutilation, maiming, or serious bodily injury in violations of the law of war, including harm to anyone “taking no active part in the hostilities” which include those “out of combat” for any reason, such as the injuries, detained or “any other cause.” The law excludes Antone harmed from “collateral damage” or “lawful attack.”
  • Thus, the Law of Nations still guides American law, as it has from the founding the of the nation, and expressly referenced within the explicit powers of Congress to enforce, be it by treaty or particular statute, or simply judicial authority to prosecute or punish.

The Barnes Brief: Weekend of March 6, 2026

I. INTRODUCTION

A. Art of the Week

  • Roulette wheel, around, around she goes, and where she ends, nobody knows. A line from a film favorite, The Good Thief. Einstein said it could only be beat in infinity, but as the character says in the film — Einstein didn’t believe in luck. The only game of chance I ever care to play, following the wisdom of my former client and old friend, Wesley Snipes: always bet on black. Let luck be a lady, and not abandon us yet.

III. CLOSING ARGUMENT: The SAVE Act Is Constitutional

  • Article I, Section 3 of the Constitution provides for Congress to regulate Congressional elections, providing that the times, places and manner for holding state rules governing such elections to federal legislative office  “may at any time by law” be altered by Congress.
  • Article IV, Section 2 provides that citizens of each state must be entitled all the privileges and immunities of citizens in the several states, while Article IV, Section 4 requires the federal government to”guarantee to every state” a “republican form of government.”
  • Amendment XIV recognizes “the right to vote” for “citizens of the United States,” with Section 5 giving Congress the power to enforce.
  • Amendment XV recognizes the “right of citizens of the United States to vote”, again affording Congress the power to enforce.
  • Amendment XIX recognize again “the right of citizens of the United States to vote” and provides Congress the power to enforce.
  • Amendment XXIV again reinforces “the right of citizens of the United States to vote” with Congress afforded power to enforce.
  • Amendment XXVI again reinforces “the right of the citizens of the United States to vote” with Congress empowered to enforce.
  • The Safeguard American Voter Eligibility Act, the so-called SAVE Act, enforces these Constitutional protections and legislative powers.
  • First, the SAVE Act does not purport to govern anything other than federal elections.
  • Second, the SAVE Act focuses on limiting voting to “the citizens of the United States” with documentary proof required.
  • As such, the SAVE Act simply enforces the Constitutional protections for citizens the right to vote by assuring their vote isn’t diluted by non-citizens.
